Quick addendum - Bush has nominated John Roberts to be the new Chief Justice...

This is a great question. Hearings for his confirmation were to begin tomorrow, but now they're being delayed. I think that ultimately he will be confirmed, though I believe that Democrats on the Senate Judiciary Committee will be tougher on him during confirmation hearings. It also will depend on who Bush chooses for the associate justice replacement... who conservative this individual is, etc. The whole thing raises a host of issues.... stay tuned!

Great point, patriotpolo4. I think that definitely could happen. The Democrats are going to do whatever it takes to get a moderate on the SC. There will certainly be a lot of bargaining involved.

Another great point, this time from musicjunkie. This could in fact be the Dems' strategy. They may let Roberts skate by, but then be tough on the next nominee. We'll see what happens when confirmation hearings begin on Monday.
